ACR Board Director Appointed to Foreign Service Grievance Board

Secretary of State Condoleezza Rice has appointed Marvin E. Johnson, Esq., a member of ACR’s Board of Directors, to the Foreign Service Grievance Board. The Grievance Board was established in 1975 by an amendment to the Foreign Service Act of 1946, and is made up of no fewer than five members, each of whom is appointed by the U.S. Secretary of State for a two-year term, subject to renewal.

Back to rudeness and barbarity, by the book

HENRY Bournes Higgins was a founding father of the constitution, a High Court judge and president of the Commonwealth Court of Conciliation and Arbitration. The dereglated industrial relations environment of the 19th century, which he described as "rude and barbarous", was replaced by a "new province for law and order", the system of conciliation and arbitration.

HK a key centre for arbitration

As arbitration has established itself as the leading process for resolving international business disputes, Hong Kong has established itself as a key arbitration centre, Secretary for Justice Wong Yan-lung says.

Addressing the "Arbitration in China" conference today, Mr Wong described some of Hong Kong's underlying strengths as a dispute-resolution centre. Notably, he said, it boasts the world-class Hong Kong International Arbitration Centre which makes about 300 awards each year

Analysis Says Mediation Has Saved Economy $9 Billion

(ADRWorld.com) - A landmark study released last week by the Federal Mediation and Conciliation Service found that the use of mediation in labor negotiations and work stoppages led to $9 billion in savings to business and workers between 1999 and 2004.

John Arnold, director of Public Affairs for FMCS, said the study is the "first of its kind to show the impact of mediation in labor negotiations" and gives FMCS independent research based on empirical evidence to show management and labor the benefits of requesting the services of an FMCS mediator.

The National Environmental Policy Act - known as the Magna Carta of US environmental laws - is under intense political scrutiny.
For 35 years, NEPA has required that everything built or operated on federal land that "significantly affects the quality of the human environment" be scrutinized for its impact. Thousands of construction projects and other ventures - from highways, dams, and water projects to military bases and oil drilling - have been adjusted and in some cases scrapped because of the law.

NSU mediation team comes in sixth at Chicago tournament

Northern State University doesn't have a law school, but a small group of students have been working to fine-tune some important legal skills.

The university's mediation team finished sixth at the National Intercollegiate Mediation Tournament hosted earlier this month by John Marshall Law School in Chicago. A team from Boston University won the national championship in the 22-team competition.

Nigeria steps up mediation in Cote d'Ivoire's conflict

ABUJA, Nov. 19 (Xinhuanet) -- Nigeria has stepped up mediation to resolve the conflict in Cote d'Ivoire, according to a statement issued weekend by the Nigerian government.

The statement said the consultations are to seek a consensus inthe appointment of a new prime minister to lead a new government of national reconciliation in Cote d'Ivoire. It added that the government "is expected to hold office until elections are held inOctober 2006."

Judge's order will allow suits vs. diocese to proceed

A judge has lifted a 2½-year-old order freezing several lawsuits accusing the Roman Catholic Diocese of San Diego of condoning or ignoring staff members who sexually abused children over the past few decades.

The move is a first step toward getting the claims of sexual abuse before juries, said a lawyer for people who say they were abused by priests and others who worked for the San Diego diocese.

Scottish mediation services to be expanded

Scotland is piloting two new in-court mediation services for minor civil disputes.

ACR member Cristina Franco received a special recognition from the Georgia Hispanic Chamber of Commerce for her work as mediator and interpreter.

A mediator, arbitrator and interpreter, Ms. Franco is the former Director of the Georgia Commission of Interpreters for the Georgia Supreme Court, where she trained more than 750 interpreters in more than 20 languages. During 2004 she mediated 55 pro-bono civil and penal cases.

African Union hopeful that Darfur peace talks will resume Sunday

A.U. Special Envoy on the peace talks, Dr. Salim Ahmed Salim, told a meeting in
Abuja Thursday that he was hopeful talks would start again Sunday.

The meeting is the first of a working group representing all parties to the talks,
established to harmonize the positions of the different groups while reducing the
hundreds of delegates to a reasonable number.

Workshop helps students resolve their problems

“The workshop is in its sixth year and is designed to train students
how to help their fellow students resolve conflicts without violence…
“In response to concerns about teen-age violence, many schools are
implementing peer mediation programs which teach resolution of conflicts
through good communication techniques,”
explained Kay Garrett, assistant professor of communications at SMSU-WP
and one of the workshop organizers. “At the camp students are trained
to mediate their peers when conflicts arise. Students involved in conflicts
at school may request mediation by one of these trained students or may
be referred to mediation by another student. Together with their peer
mediators, the students work to find a solution they can accept in order
to resolve their conflict.”

ACR is pleased to announce the designation of one of its members, Mr. James MacPherson, to work as Senior Advisor for a U.S. State Department-funded / American Bar Association legal reform initiative (including ADR) in the Middle East. Mr. MacPherson’s office will be located in the Ministry of Justice in the Kingdom of Bahrain. His responsibilities will include teaching mediation in Amman, Jordan to 25 judges and senior attorneys this June. In July, he will briefly work in Istanbul, Turkey.

ACR Member Nancy Neal Yeend presents evaluation of the Nevada Supreme Court's Settlement Conference Program

ACR Member Nancy Neal Yeend just completed the evaluation of the Nevada Supreme Court's Settlement Conference Program. The Settlement Conference Judges serve as mediators, handling approximately 600 cases per year. This is one of the largest appellate ADR programs in the country, and is the largest for a state that does not have an intermediate court of appeal. The average settlement rate for the 7-year old program is 58 percent, which is one of the highest in the nation.

ACR Member Lynne Kinnucan working on gang-prevention initiatives in Long Island

ACR member and former ACR staff member Lynne Kinnucan is currently involved in gang-prevention work in Long Island, where she moved with her husband in July of 2004. Lynne has been appointed to the Violence Intervention Project (V.I.P.) of Nassau County, where she is a member of the Crisis Response Committee. The V.I.P. is headed by Sergio Argueta, a former gang member who left the gang life when a close friend was shot in a gang fight. Mr. Argueta is now completing his degree in Criminal Justice and travels to schools around Long Island, talking about his experiences as a gang leader, and offering alternatives to youth who are at risk of becoming involved in gangs.

    ACR Board Member Diane Kenty will be travelling to Amman, Jordan for two weeks in 2005 through the American Bar Association’s Central European and Eurasian Law Initiative (CEELI).     School Without Walls Students Visit ACR

    ACR staff hosted a group of students from the Washington, D.C. School without Walls alternative DC public high school. The group of 20-22 teenagers are students of Coleman McCarthy, well-known nonviolence activist and educator. ACR staff members David Hart, Jennifer Druliner, Anne Gallivan, Mark Wilson and Nussi Abdullah met with the group to discuss the importance of conflict resolution in our world today and the students' particular interests in its application.

    Red Lake, MN Shooting: As Conflict Resolvers, What Can We Do?

    ACR Members Interviewed on Jamaican Radio Show


    On November 29, 2004, ACR President-Elect Terry Wheeler, along with Jamaica Dispute Resolution Foundation Executive Director and ACR member Donna Parchment, were invited to appear on Jamaica's flagship morning radio discussion program.

    Terry and Donna discussed the importance of conflict resolution for the Jamaican business community with hosts Beverley Anderson Manley (former First Lady of Jamaica) and Anthony Abrahams (former Jamaican Minister of Tourism).

    Adam J. Berner, an ACR member for 10 years, has become the President of the Family and Divorce Mediation Council of Greater New York.     ACR Hires New Sections Manager

    Anne-Marie L. Burton has more than four years of association management experience. In her previous position with the American Academy of Otolaryngology-Head and Neck Surgery, she served as their Member Relations Coordinator. In this capacity, Anne-Marie promoted and coordinated Academy initiatives as they related to the section for Residents and Fellows,
    managed the Academy volunteer and public relations education program, developed and recommended changes in project procedures to the members, wrote quarterly articles for the Academy Magazine and Bulletin and worked with committees and the Board. Anne-Marie also worked with the Genocide Prevention Center as their Assistant Director.

    ACR and People to People Delegation to South Africa

    A diverse delegation of ACR members participated in a People to People professional exchange to South Africa on November 7-19, 2004. The delegation, led by ACR CEO David Hart and Mark Wilson, studied the nation's emergence from decades of apartheid and South Africa's development of a democratic society. Delegates learned about South Africa's truth and reconciliation programs and shared ideas with their counterparts in South Africa.

    Distinguished Delegation from Kenya visits ACR

    ACR staff and Board Members Anne Thomas and Peter Maida hosted a distinguished delegation on Monday, October 18, at the ACR office in Washinton, D.C.
