Cutting Edge Research and
Practice Advice: A Conversation
with Contributors to Conflict
Resolution Quarterly Spring 2009
Issue
Date:
September 17, 2009, 3:00 pm (Eastern)
Join other ACR members for this
FREE teleconference. The call
will be moderated by Susan
Raines, Editor-in-Chief of
Conflict Resolution Quarterly.
Confirmed authors include James
Wall, Lorig Charkoudian, Drs.
Robert Silver and Richard
McGuigan.
Wall’s work with Suzanne Chan-Serafin
on civil mediation examines the
techniques mediators use with
plaintiffs compared to those
used in dealing with defendants,
which side is likely to make the
largest concessions and the
utility of various mediation
styles and practices on
settlement. Charkoudian’s work
with Cristian de Ritis, Ramona
Buck and Carrie L. Wilson,
examines the core behaviors that
mediators “say they do” (or
don’t do) through self-reports.
The authors then observed
mediators in actual mediations
to record their actual behavior
and techniques. Robert Silver,
along with Deborah Silver,
reviews the development of the
Sieve Model, currently being
used in the 20th Judicial
Circuit in Florida. Richard
McGuigan examines the issues
related to inadvertent mediator
bias and the importance of
reflective practice. In this
program, each case is directed
toward those processes that seem
to be the best fit, starting
generally with the least
adversarial methods possible.

dial in instructions by email.

Commercial Contracts and Alternative Dispute
Resolution
Date:
January 22-23, 2009
(Postponed from
November 27-28,
2008)
Place:
Taj President Mumbai, India
Every legal professional
knows that there is no blueprint that
can protect contracts and projects from
disputes. Corporate litigation cases are
reported virtually everyday in the news.
Frequently, they relate to disputes
arising from interpretation of
documents, breach of contracts and
infringements of rights. This conference
will help your organization reduce
exposure and avoid litigation by being
fully conversant with the knowledge,
skills and strategies in ensuring that
your contracts are well negotiated,
properly drafted and managed.
Key issues to be addressed
include:
-
Essentials of contract law, examining
details such as when you need a
contract, what types of contracts exist
and the effect of statutory law on your
contractual arrangements.
-
Crucial ingredients required for a good
contract, examining exclusion and
indemnity clauses, intellectual property
rights, termination, breach of contract,
variation and modification, risk control
-
Key
consideration when drafting
international contracts
-
Options for assessing damages and
remedies for breach
-
Drafting and negotiating contractual
dispute resolution clauses and examining
and managing disputes in cross border
contracts

This is an
exciting time for the field of conflict

as we work together to take ACR to new
levels. To that end, we are continuing a
Listening Initiative to provide you with
opportunities to speak directly to ACR Board

anticipate that these listening sessions will
lead to a rich dialogue regarding the future of
ACR.
This is the
first of two Listening Initiative teleconference

The United
States Institute of Peace (USIP) is proud to
unveil its new conflict management education
and training program. A program is needed in
which professionals from government, the
military, NGOs, and IOs, as well as
pre-professionals in the academic world, can
come together and receive training on core
conflict management skills, as well as best
practices in conflict prevention,
peacemaking, and state-building. To address
this need, USIP is expanding its education
and training programs to prepare
practitioners to work effectively in
conflict zones. Drawing on USIP's 20 years
of leadership in the field of conflict
management, these courses will complement
existing academic programs in international
security and conflict
management. Participants from backgrounds as
diverse as education, the military,
international organizations, the non-profit
sector, and international development
agencies will have a unique opportunity to
enjoy a common learning experience. USIP's
conflict management program will respond to
both individual career needs and the
ever-increasing demand for conflict
management professionals. These courses at
present are free of charge, but you must
apply.
